When an individual has been deported from Canada, they may need to apply for an Authorization to Return to Canada (“ARC”) before being allowed back in the country. The timeline for how long you must wait until you can apply to come back to Canada depends on the kind of removal order that was issued against you before you were deported.
What Happens When Filing for an Authorization to Return to Canada?
Your ARC application will be examined by an officer who will ascertain the validity of your reason for returning. When filing for an Authorization to Return to Canada, the officer looks at the following:
- How much time has passed since the deportation
- Reason for returning to Canada
- Why you were deported
- Examination of your ties to Canada, home country, and likelihood of repeating the previous offense that led to deportation
- Likelihood you will return to your home country after your stay (if temporary)
What Circumstances Do Not Require an Authorization to Return to Canada?
Departure Order
If you received a departure order, you left Canada within the 30-day time frame, and that departure was verified by an officer, then you do not have to apply for an ARC. If you do not meet these three requirements, then you must apply for an Authorization to Return to Canada.
Exclusion Order
If you received an Exclusion Order, you have been outside of Canada for more than one year since removal, and you hold a dated Certificate of Departure, then you do not need to apply for an ARC. If you do not meet these criteria, then you must apply for one.
Deportation Order
If you received a Deportation Order, then you must apply for an ARC prior to traveling to Canada.
